Will Hawaiian Cops Have to Stop Getting Free Sex with Hookers?

HONOLULU, HI—Who knew? For many years now—it’s difficult to find out how many—police officers on Hawaii’s Vice Squad have been soliciting—and getting—sex with local prostitutes, and after they’ve gotten their rocks off, busting the gals for prostitution. But looks like the “John Squad” may soon have to pay for the privilege just like everyone else, if Hawaii’s House Bill 1926 gets changed once again now that it’s in the hands of the state Senate.z_prostitution_hawaii000

See, HB 1926’s main effect on sex would have been to reform Sections 706 and 707 of the state’s Criminal Code to make “sadomasochistic abuse” a crime under the prostitution laws, as well as to amend the Code to increase penalties for those who pimp out minors, though there’s an exemption in there for “johns” who are not more than two years older than the underage hooker—and of course, the fines for the illegal behavior are more than doubled as well.

But one of the things Hawaiians are up in arms about is that the Code, as it currently stands,  contains the following exemption for cops: “This section shall not apply to any member of a police department, a sheriff, or a law enforcement officer acting in the course and scope of duties.” Perhaps worse, that same language is contained in the version of HB 1926 that was sent to the Senate, except this time, the exemption is extended to cops’ solicitation of minors for sex! And while the bill’s authors—House Vice (no pun intended) Speaker John Mizuno, and Reps. Mele Carroll, Tom Brower and Karen Awana—stated that one of the purposes of the bill was to remove both exemptions entirely, once the House heard testimony from the cops, the exemptions were restored.

One of the interesting aspects of the proposed law’s original version is its cross-section of support. Not only were prostitutes’ advocates heard from, but even whackjob anti-prostitution activist Melissa Farley supported it.

“Police abuse is part of the life of prostitution,” Farley, the executive director of the San Francisco-based group Prostitution Research and Education, stated, adding that “women who have escaped prostitution” commonly report being coerced into giving police sexual favors to keep from being arrested.

In any case, once the Senate began its hearing on the bill, the story was a bit different. No police testified at that hearing, but the pols heard plenty from the citizens. Of particular note was the testimony of attorney Myles Breiner, who stated that one of his clients, a prostitute, had sex with at least three officers before being busted for the crime. Besides Hawaii’s law, just like almost every other state law in the nation, doesn’t require that the sex act(s) be completed before a bust can take place.

“Would it be OK if a policeman did ecstasy to make sure it is the real stuff? I find this type of legislation to be really baffling and confusing,” said advocate Katie Caldwell.

“[The] statute, the language has not changed. Crime is committed by verbal agreement,” Breiner said. “You don’t need to engage in sex to commit the offense. It’s ludicrous.”

“You can expect that exemption will be out of the recommendations of the chair,” responded Senate Judiciary and Labor Committee Chairperson Clayton Hee.

Maybe… but the Judiciary Committee decided to defer its vote on the matter until this Friday, March 28. Why? We don’t know—but there’s little doubt that “law enforcement” will be working behind the scenes to get their sexual privileges restored.

Police officer hacks off woman’s hair

In November of last year, 22-year-old Charda Gregory went to a party in Detroit, Michigan. WXYZ Action News reports that Gregory believes that while at the party she was drugged. When she regained consciousness in a different place, a motel room in Warren, Michigan. Before she knew it, Gregory was being arrested for trashing the room and was taken to jail located inside the Warren Police Department. Sadly enough, the police station did not prove to be a safe harbor.

WJBK Fox 2 News reports that Gregory had also been arrested for assaulting a police officer, so she had been pepper sprayed by the time she had been brought to the jail. While calm, she could barely stand. The young mother, who is also a hair dresser, was then approached by Officer Bernadette Najor. Officer Najor started to pat down Gregory rather roughly. It appears that Gregory started to resist. It was then that Najor and three other officers strapped her into a chair.

Paul Misukewicz, Gregory’s attorney, told WXYZ that the officer then did something bizarre, “[Najor] took it upon herself to get the scissors. And for whatever reason, decided that she was going to butcher my client.”

Over the course of three minutes, Najor hacked away at Gregory’s weave. Often officers will remove hair extension clips because they can be used as weapons in a pinch. However, Gregory’s weave was not clipped in, but sewn in. Because of the work done to her scalp by Najor, Ms. Gregory says that she now has bald spot. Misukewicz characterized it as “sadistic.”

When Warren Police Commissioner Jere Green, City Attorney David Griem, and other local officials learned of the incident, they quickly decided to fire Officer Najor. Commissioner Green told WXYZ, “I don’t buy that’s the proper way to treat a human being. I don’t think it’s decent, I don’t think there was any reason to do it, and when I look at it – that bothers me.” Griem told WJBK, “There is a policy about removing wigs, but, that doesn’t cover scalping a person.”

WJBK reports that David Griem told them that Ms. Gregory settled a lawsuit with Warren out of court. The criminal charges that were filed against her at the time have been dismissed.

As for the now former police officer, Bernadette Najor, she refused to talk to WXYZ about the matter. The station found out she has had disciplinary problems in the past. WJBK reports that the officers who were there but did nothing to stop Najor probably won’t be fired, but may be disciplined.

Man beaten by sheriff’s deputies over small pipe, family says

“This is one of the worst beatings I have ever seen,” a hospital worker told General Strike USA.

Witnesses put the number of police and deputies who assisted in Stark’s beating between 12 and 18.

Deputies allege in an affidavit that Terry “Jason” Stark, 32 of Festus, initially refused to follow their orders and witnesses told GS that Stark ran from deputies. “I know he messed up and shouldn’t have resisted arrest, but there was no reason for them beating him that bad.” said Stark’s wife, Paige Stark.

A Missouri man suffered serious injuries to his face, head and other areas as a result of being beaten by several Jefferson County sheriff’s deputies Wednesday during an arrest over a piece of steel pipe, the man’s family alleges.

Terry “Jason” Stark, 32 of Festus, is charged with assaulting a law enforcement officer according to court records. An affidavit filed in the case alleges Stark “attempt to cause physical injury to deputies on scene and I by kicking at our persons as we attempted to handcuff him,” Deputy Daniel Lehman wrote in the affidavit.

Lehman also alleged in the affidavit that “Deputy Faulkner” told him during the scuffle Stark “kicked him several times in his upper legs” while both he and Stark were on the ground.

It is unclear how Stark, while lying on the ground with Fauklner, could have been in a position to kick him in his upper leg area.

According to the affidavit, Stark’s alleged assault only amounted to either kicking or attempting to kick two deputies. It is not clear how Stark ended up with such severe injuries, most to his head and face and yet according to Lehman’s affidavit, none of the deputies involved sustained any injuries

Deputies took Stark to Mercy Jefferson Hospital in Festus shortly after his arrest, and then to the Hillsboro County Jail where he remains pending a future court date.

Stark’s mother, Rhonda Stark of Desoto, told reporters “Before they took him to the hospital a cop said, ‘Yeah we really boogered him up.’” Rhonda said “boogered up means giving someone a severe beating.”

Stark’s cousin Jesse Stark told reporters, “He was standing by his truck and two minutes later he was on the ground with a cop.” “The cop didn’t ever tell him why he was there and just said ‘put your hands behind your back,’ he was just standing by his truck,” he added.

“He works hard, he is married and stays out of trouble. I don’t see why they had to beat him so bad,’ Rhonda said.

Paige said, “They stapled his head without anesthesia, they put stitches in his face, there is a dent in his head from being hit with a Mag light, he might have a broken jaw, and they broke some of his teeth out, and he has broken fingers on both his hands.”

One deputy said, “I have no problem shooting your husband in the face,” Paige said. After seeing Stark last night at the jail Paige said, “I can’t believe it. He still has on the same bloody clothes, he hasn’t had a shower, he can barely talk and he is in a lot of pain.”

“They beat me so bad it feels like my legs are mangled,” Paige said Stark told her during last night’s visit. Stark added “I don’t know why I am in here,” Paige said.

“My husband also told me a cop said to him ‘I would have no trouble shooting you 30 times in your fu***** face,’” Paige said.

Stark has no prior criminal history according to a search of online Missouri court records. Stark has not been the only person to allege Jefferson County deputies have used excessive force.

According to a 2007 federal lawsuit filed against several Jefferson County deputies, former deputy Timothy Groat shot and killed Gary Byrd during a car chase.

Celestine Dotson, attorney for Bird’s family, said Bird “was never an imminent threat to the officers. He was attempting to escape,” according to a report by St. Louis Today.

Dotson said deputies fabricated their stories about what happened during their hour together before giving statements. Also according to report, deputies agreed that they had no reason to believe Bird had a gun.

A Justice for Jason Facebook page been created and is asking that witneses to Wednesday’s incident to come forward.

A spokesperson for the sheriff’s department said he had not reviewed the police report as of Friday. Jefferson County is approximately 50 miles south of St. Louis.

110 Police Officers Arrested

Police department figures show the arrests of about 110 police officers, for both on- and off-duty conduct, since 2009. Many of the arrests involved traffic violations or involved cases that were dropped or ended in acquittal.

Among the most serious cases was Richmond Phillips, who received life without parole last year for the slayings of his mistress and baby daughter. Wendel Palmer was convicted last year of sexually abusing a girl who participated in his church choir, while Kenneth Furr received a 14-month sentence for an armed altercation that began after prosecutors say he solicited sex from a transgender prostitute.

Lanier has said many of the arrested officers were brought onto the force during a time of lax hiring standards and wouldn’t be qualified to serve today. She said that in some cases the arbitration process has required the department to rehire officers it fired.

In a single month, one District of Columbia police officer was accused of taking semi-nude pictures of a 15-year-old runaway and another was charged with running a prostitution operation involving teenage girls. A third was indicted on an attempted murder charge, accused of striking his wife in the head with a light fixture.

A D.C. police officer was arrested and charged with production of child pornography while on duty, the Metropolitan Police Department announced.

Officer Marc Washington is accused of taking digital photographs of a 15-year-old girl after ordering her to remove her clothes.

Washington — an officer with MPD since 2006 — was arrested Monday, shortly after the victim’s mother called police, authorities said.

According to charging documents, Washington first made contact with the family when the girl’s mother called police to report her missing. Washington went to the family’s home to take a missing persons report.

The girl returned home Sunday afternoon, but later that night, according to authorities, Washington went back to the apartment and asked to speak to the girl privately. He entered her bedroom and ordered her to remove her clothing, telling her he needed to take photographs of any injuries she’d sustained while missing, say charging documents.

The girl said she wasn’t hurt, but he told her it was part of the procedure and she complied, the documents say.

After he left, the victim told her mother, who called police.

Washington was pulled over while still on duty. Authorities recovered a dozen images of the girl from his camera, including nine that had been deleted but were recoverable, authorities said.

Authorities also found other photos — including nude images — of unidentified people on Washington’s camera.

They said at least two of the subjects appear to be minors.

Prostitution case

D.C. police officer accused of prostituting teenage girls was arrested Wednesday after a week-long investigation that began when the search for a missing 16-year-old girl led police to his apartment.

New details provided in documents filed at Officer Linwood Barnhill Jr.’s first court appearance say he met that girl at a shopping mall and a second at a bus stop, and recruited them as models before arranging for them to meet older men for trysts costing up to $80.

Barnhill, who has been on the force 24 years and was assigned to the 7th District in Southeast Washington, was charged with two counts of pandering a minor for the purpose of prostitution.

The charges against the 47-year-old came hours after police and firefighter divers pulled another officer who faced criminal prosecution from the Potomac River. Marc Washington, 32, a seven-year veteran also assigned to the 7th District, died a few hours later at a hospital, a day after he was released from jail, put on a 24-hour curfew at his Waldorf home and ordered to wear an electronic monitoring bracelet.

Washington was charged last week with taking pictures of a semi-naked 15-year-old who had run away from home and later returned safely. A cause of death has not been determined. His attorney declined to comment.

According to the documents, D.C. police went there Dec. 3 and confronted Barnhill, who was there with the missing girl and another female who initially said she was 18. Police said they later learned she was 15.

Authorities said in the documents that they smelled burnt marijuana and later found the drug in the officer’s bedroom. The 16-year-old told police she had been at the apartment several times after she met the officer at a mall. She said she was photographed nude and told she would get a new hairstyle, shoes and clothes. Barnhill told her she would go by the name “Juicy” and arranged for her to have sex with an older man for $80, the court documents say.

The girl also said that she met six young women or girls at the apartment and that their services had been advertised on Backpage.com, an Internet bulletin board, court papers say. The standard fee, the girl told police, was $80 for sex, with $20 going to the officer.

Police said they seized a mirror with the names of women, whom the teenager said worked as prostitutes, written on it, along with high-heel shoes, condoms, eight cellphones, a laptop computer and the officer’s 2004 black Lincoln Navigator.

Police said in court documents that the Lincoln was used to pick up the 15-year-old girl at the bus stop at Jasper Street and Alabama Avenue SE. Police said the officer regularly met her there starting in September. The documents say the officer asked her to be an escort, telling her “he plans bachelor parties and has ‘tons’ of girls,” according to the court papers. The girl told police that the officer “told her that her young age was not a problem because he had other minors who worked for him.”

At  one photo session, authorities said the girl was accompanied by an adult female relative who waited in the officer’s living room while he took nude pictures of the girl in his bedroom, using a cellphone, court papers say.

A Prince George’s County judge has ordered that a D.C. police officer charged with trying to kill his wife be confined to his parents’ home with electronic monitoring.

Prosecutors requested Thursday that Samson Lawrence III be held or monitored electronically until trial because his wife fears for herself and her children. His attorney argued Lawrence hadn’t violated his bond terms and it would be unnecessary.

Lawrence had been out on a $200,000 bond after he was charged with attempted murder, assault and possessing a dangerous weapon with intent to injure.

Prosecutors say Lawrence beat his wife, who has a brain tumor, in the head in an effort to kill her at their Accokeek home. They say Lawrence also threatened her with knives and tried to keep her from calling 911.

Gun owner unarmed, unwelcome in Maryland

HUDSON – John Filippidis, silver-haired family man, business owner, employer and taxpayer, is also licensed to carry a concealed firearm.

He’d rather he didn’t feel the need, “but things aren’t like they used to be. The break-ins, the burglaries, all the crime. And I carry cash a lot of the time. I’m constantly going to the bank.

“I wanted to be able to defend my family, my household and the ground I’m standing on. But I’m not looking for any trouble.”

Filippidis keeps his gun — a palm-sized Kel-Tec .38 semiautomatic, barely larger than a smartphone in a protective case — in one of two places, always: in the right-hand pocket of his jeans, or in the safe at home.

“There are kids in the house,” Filippidis says, “and I don’t think they’d ever bother with it, but I don’t want to take any chances.”

He’s not looking for any trouble, after all.

Trouble, in fact, was the last thing on his mind a few weeks back as the Filippidises packed for Christmas and a family wedding in Woodridge, N.J., so he left the pistol locked in the safe. The state of Florida might have codified his Second Amendment rights, but he knew he’d be passing through states where recent U.S. Supreme Court decisions affirming the rights of individuals to keep and bear arms have been met by hostile legislatures and local officials.

“I know the laws and I know the rules,” Filippidis says. There are, after all, ways gun owners can travel legally with firearms through hostile states. “But I just think it’s a better idea to leave it home.”

So there the Filippidises were on New Year’s Eve eve, southbound on Interstate 95 — John; wife Kally (his Gulf High sweetheart); the 17-year-old twins Nasia and Yianni; and 13-year-old Gina in their 2012 Ford Expedition — just barely out of the Fort McHenry Tunnel into Maryland, blissfully unarmed and minding their own business when they noticed they were being bird-dogged by an unmarked patrol car. It flanked them a while, then pulled ahead of them, then fell in behind them.

“Ten minutes he’s behind us,” John says. “We weren’t speeding. In fact, lots of other cars were whizzing past.”

“You know you have a police car behind you, you don’t speed, right?” Kally adds.

Says John, “We keep wondering, is he going to do something?”

Finally the patrol car’s emergency lights come on, and it’s almost a relief. Whatever was going on, they’d be able to get it over with now. The officer — from the Transportation Authority Police, as it turns out, Maryland’s version of the New York-New Jersey Port Authority — strolls up, does the license and registration bit, and returns to his car.

According to Kally and John (but not MTAP, which, pending investigation, could not comment), what happened next went like this:

Ten minutes later he’s back, and he wants John out of the Expedition. Retreating to the space between the SUV and the unmarked car, the officer orders John to hook his thumbs behind his back and spread his feet. “You own a gun,” the officer says. “Where is it?”

“At home in my safe,” John answers.

“Don’t move,” says the officer.

Now he’s at the passenger’s window. “Your husband owns a gun,” he says. “Where is it?”

First Kally says, “I don’t know.” Retelling it later she says, “And that’s all I should have said.” Instead, attempting to be helpful, she added, “Maybe in the glove [box]. Maybe in the console. I’m scared of it. I don’t want to have anything to do with it. I might shoot right through my foot.”

The officer came back to John. “You’re a liar. You’re lying to me. Your family says you have it. Where is the gun? Tell me where it is and we can resolve this right now.”

Of course, John couldn’t show him what didn’t exist, but Kally’s failure to corroborate John’s account, the officer would tell them later, was the probable cause that allowed him to summon backup — three marked cars joined the lineup along the I-95 shoulder — and empty the Expedition of riders, luggage, Christmas gifts, laundry bags; to pat down Kally and Yianni; to explore the engine compartment and probe inside door panels; and to separate and isolate the Filippidises in the back seats of the patrol cars.

Ninety minutes later, or maybe it was two hours — “It felt like forever,” Kally says — no weapon found and their possessions repacked, the episode ended … with the officer writing out a warning.

“All that time, he’s humiliating me in front of my family, making me feel like a criminal,” John says. “I’ve never been to prison, never declared bankruptcy, I pay my taxes, support my 20 employees’ families; I’ve never been in any kind of trouble.”

Face red, eyes shining, John pounds his knees. “And he wants to put me in jail. He wants to put me in jail. For no reason. He wants to take my wife and children away and put me in jail. In America, how does such a thing happen? … And after all that, he didn’t even write me a ticket.”

Now, despite having fielded apologies from the officer’s captain as well as from a Maryland Transportation Authority Police internal affairs captain, John is wondering if he shouldn’t just cancel his CCW license.

For a guy who’s not looking for trouble, that’s not an unreasonable conclusion. And it would please fans of gun control by any means. But let’s hope John Filippidis, American family man, taxpayer and good guy, doesn’t cave, because it would be a sad statement about the brittleness of our guarantees — some would call them sacred — under the Constitution.

Police Are Trampling On the Rights Of American Citizens — And Finally We Have A Chance To Fight Back

Police misconduct is out of control in Indiana. In 2010, two Indiana police, including a captain, slapped and tasered a 10-year-old boy at a daycare center. That same year, an Indianapolis police officer killed a motorist while drunk and on duty. And the city of Indianapolis recently threatened citizens with a $2,500 fine just for protesting tickets or filing formal complaints.

Thankfully, the Indiana legislature just passed a law that will give Hoosiers some recourse against police injustice, allowing citizens to use force against police officers who unlawfully enter their homes. The bill is a huge victory for the Fourth Amendment. But by also putting increasingly unlawful police conduct under the microscope and putting some restraint on police, the Indiana legislature is giving us an example of how to further restore law enforcement agencies to their constitutional roles.

 

Nationally, police misconduct is even worse than in Indiana. As detailed by the likes of great journalists and constitutional lawyers like John Whitehead, Radley Balko, and Will Grigg (just to name a few), in the past 30 years American law enforcement agencies have morphed into federally-funded paramilitary units whose often-deadly actions receive incredible amounts of protection and immunity.

Almost daily, there are incidents of police conducting illegal cavity searches at traffic stops, dogs being shot, local sheriffs ignoring laws that expand individual freedom, murders of the mentally handicapped, wrongful convictions by hawkish prosecutors, and countless stories of innocent people being on the wrong end of the state’s enforcement arm. All of these heinous acts, and the police’s opposition to any legal restrictions on their powers, are masked by the holy writ of “officer safety.”

The most important weapon in the fight against these police abuses is the ability of the internet to turn local stories into national ones. The cell phone (or dash) camera, combined with the interconnectedness of the web, has replaced the musket as the best defense against government abuse. Thanks to this, millions and millions of people are now able to see the reality of what police departments have turned into.

 

Unfortunately, this hasn’t stopped the steady expansion of the American police state. Even though private violent crime has been on a steady decline for the last 20 years, police activity has exploded. There are over 50,000 SWAT raids conducted annually in the U.S., and even smaller cities with virtually no crime are being swallowed up by Homeland Security grants that arm police with weapons usually reserved for foreign subjects. While the Posse Comitatus Act theoretically protects American citizens against the military being used to enforce law and order, what does it matter when police agencies — in their manner, dress, weaponry, tactics, and aggression — resemble an occupying army?

 

And to make matter worse, what happens to those few, brave cops who actually want to protect people and report these unlawful acts committed by their fellow officers? They are either fired or met with stiff resistance.

 

There are many reasons for this radical transformation of police power. The drug war — especially since the Reagan administration — amped it up; and the politicization of society — which makes nearly every action short of breathing subject to detailed state regulation — requires massive amounts of police power to enforce.

 

However, there is both historical and legal precedence for a check against growing police abuse. In both English common law and American law that was adopted when this country was formed, it was not just the right but the duty of citizens to resist unlawful arrests and abductions. The classical liberal tradition holds that this is a hallmark of a free society and that it represents one of the strongest bulwarks against abusive state power.

 

In a time when some politicians want to give police the authority to conduct unannounced, warrantless house searches to enforce gun laws, just imagine how much freer and “secure in [our] persons, houses, papers, and effects” we would be if the right and duty to resist unlawful state action was codified throughout the country.

Since local police departments are now quickly becoming vestiges of the Pentagon and continue to threaten the life, liberty, and property of every American, severe restraints are needed now more than ever. Ultimately, the real problem lies with trusting our security to an institution with a monopoly on aggression and violence; the free market can and does provide law and order cheaper and safer.

But for now, let us hope that the steps taken by the Indiana legislature to restrain the heart and soul of state power continue and are emulated throughout the country.

17 men arrested in Phila. prostitution sting

In a three-day undercover sting last week, Philadelphia police said, 17 men were charged with soliciting prostitutes – including one who allegedly sucker-punched an officer during his arrest.

On Friday, the last day of the sting, Mad Shin, 41, of Oaklyn, Pa., allegedly tried to solicit sex from an undercover officer posing as a prostitute, Lt. Derrick Wood, the commander of the department’s Vice Unit, said Tuesday.

The officer signaled to backup officers, but as one tried to put Shin in handcuffs, he allegedly punched the officer in the face, Wood said. He then allegedly hit the officer several more times before he was finally handcuffed, Wood said. The officer suffered a swollen bump over his left eye and pain in his shoulder, but did not seek medical attention.

In addition to being charged with soliciting and patronizing a prostitute, Shin faces charges of assaulting a law enforcement officer, simple assault, recklessly endangering a person, and resisting arrest.

The sting took place in the department’s East, Northeast, and South Divisions Oct. 8, last Wednesday, and Friday, police said. In addition to the 17 men arrested, including an 83-year-old man from Bustleton arrested about 12:30 p.m. on the first day of the sting, the Vice Unit confiscated nine cars and $4,849 in cash.

Such stings are periodic and usually result in 15 to 30 would-be johns under arrest, Wood said. Teams of about three to four officers target areas where police have fielded complaints about street prostitution, Wood said.

“We get complaints from people reporting prostitutes and johns having sex in cars, leaving condoms on the street,” he said. “We target areas based on what we see and what the people of Philadelphia tell us.”

Wood’s unit has arrested 180 men on solicitation charges since Jan. 3, he said.
